The deugro group is committed to working with the highest standards of business ethics, including international compliance with data protection laws. We view it as our duty, as a trusted international corporation, to comply with the various legal regulations around the world that govern the collection and processing of personal data. This Data Privacy Statement needs to be read carefully in order to fully understand our practices relating to personal data.

References in this Data Privacy Statement to “deugro group”, “we”, or “us”, refers to all deugro group companies worldwide, including DEHOCO AG a Swiss limited company and any wholly-owned or majority-owned affiliates and subsidiaries of the foregoing. Reference in this Data Privacy Statement to “personal data” means any information that identifies, or could reasonably be used to identify, a natural person, either on its own or together with other information.

Personal Data

The personal data that we collect and use, in accordance with applicable law, may include:

  • basic data, such as your name, your employer, your title or position;
  • business contact data, such as your physical business address, email address and phone number(s);
  • financial data, such as company or personal bank account details;
  • technical data, such as your IP address and other information collected from your visits to our website;
  • data you provide to us for the purpose of attending meetings, events, or work sites including ports and other locations requiring personal identification;
  • identification and background data provided by you or collected by us as part of our client or business partner onboarding process;
  • personal data provided to us by or on behalf of our clients, which may include special categories of data;
  • details of your visits to our offices; and

Collecting your personal data

We regularly receive personal data as part of our professional activities. We may collect your personal data in accordance with applicable law:

  • as part of our client onboarding procedure;
  • as part of our subcontractor or agent onboarding procedure;
  • when you seek employment from us;
  • when you or your organization offer or provide services to us as vendor;
  • when you browse or interact with our website(s)
  • when you email us or provide such data to us in other circumstances, such as when you request details about or attend a company sponsored event, or when you engage with careers

 

Ordinarily, you will have provided any such data to us. But in some cases, we may collect data about you from a third-party source, such as government or credit reporting agencies, an information or service provider or from public records.

 

Using your personal data

We only use your personal data in connection with our ordinary professional activities (including the fulfilment of our legal or regulatory obligations). These “Permitted Uses” may include:

  • providing services to our clients;
  • managing our business relationship with you or your organization in connection with the provision or procurement of goods or services, including processing payments, accounting, auditing, billing and collection and related support services;
  • managing and securing the access to our offices, systems and online platforms;
  • complying with all legal and regulatory requirements;
  • processing that is necessary for purposes of our legitimate interest or third parties provided that such interests are not overridden by your interests or your fundamental rights and freedoms; and
  • for any other purpose for which you provided the personal data to the deugro

 

If you have given us your (in some cases explicit) consent for a specific data processing activity, we may process your personal data for such purposes. You may withdraw your consent at any time, and the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Such purposes for which we may process your personal data may include:

  • communicating with you with respect to market developments, announcements, events and services which may be of interest to you;
  • distributing surveys or marketing materials through specific channels;
  • gathering information regarding your preferences to improve the quality of our communications and interaction with you, such as through website analytics or the tracking of our client publications; and
  • any other purpose for which you have given us your (explicit)

 

Sharing your personal data

Despite how we obtain your personal data, it may be shared among all the offices within the deugro group if there is a legal basis to do so. In such cases, we have an intra-group agreement governing data sharing based on EU approved Model Clauses to ensure all our offices at all times has a level of data protection at least as strict as those required by the laws of Switzerland and the EU General Data Protection Regulation (“GDPR”).

We may also need to transfer personal data to third parties including third parties based outside Switzerland or the EU, for example (but not limited to) subcontractors, agents, vendors, external counsel, accountants, border control agents or other government authorities, ground services at airports, ports, or train stations, and any other third parties involved in your business relationship with us. When we share or transfer your personal data, we do so in accordance with applicable data protection laws and take appropriate safeguards to ensure its integrity and protection, based on the condition that enforceable data protection rights and effective legal remedies for data subjects are available.

We will not share your personal data with any third party outside the deugro group for purposes of allowing them to market their products or services to you unless we have obtained your prior and explicit consent.

 

Third party platform advertising

We may share your information with third party platform providers (such as Facebook, Google, LinkedIn and Twitter), if we have a legal basis for providing targeted advertising/content to you through the relevant third-party platform based on your profile/interests. Your information is used by the third-party platform provider to identify your account and serve advertisements to you. You can control the advertisements you receive via the privacy settings on the relevant provider’s platform, and you should consult the third party’s help/support center for more information.

 

Keeping your personal data secure

We take appropriate technical and organizational measures at all times against unauthorized or unlawful processing of your personal data and against accidental loss or destruction of, or damage to, your personal data in accordance with our internal security procedures covering its storage, access and destruction.

Personal data may be stored on our own technology systems, those of our data processors or those of our vendors or in paper files.

Where processing is to be carried out on our behalf by a data processor, we make sure we have contractual provisions with the processor to provide sufficient guarantees and to implement appropriate technical and organizational measures in such a manner that processing will meet the requirements of data protection laws to ensure the protection of your rights.

 

Privacy by design

deugro-group has adopted the principle of privacy by design and will ensure that the definition and planning of all new or significantly changed systems that collect, or process personal data will be subject to due consideration of privacy issues, including the completion of one or more data protection impact assessments.

 

Retaining your personal data

We can retain your personal data until it is no longer reasonably required for the Permitted Uses, or you withdraw your consent, if we are not legally required or otherwise permitted to continue to hold such data. We may retain your personal data for an additional period of time and restrict the processing to the extent that deletion would require us to overwrite our automated disaster recovery backup systems or to the extent that we deem it necessary to assert or defend legal claims during any relevant retention period.

 

Your rights regarding your personal data

Under applicable data protection legislation, we are required and will provide you, upon request, with a copy of your personal data and correct any inaccuracies identified by you.

Except as in specific cases, we do not use your personal data for any automated decision making, including any profiling. In addition, you have the right to restrict our processing of your personal data as well as the right to lodge a complaint with supervisory authorities regarding the processing of your personal data. We will not be sending you marketing materials without your explicit consent and will also comply with any request to stop sending any such communications to you. You also have the right to erasure of your personal data with given cases of exemptions.

 

Updates to this Privacy Notice

We reserve the right to amend this Privacy Notice from time to time to reflect changing legal requirements or our processing practices.
